BURN BAN

Bridlewood documents do not allow burning trash, tree/shrubs, building material, etc. The only time that property owners are allowed to burn is when you are preparing your lot for building a home. You can at that time burn shrubs that are being removed for the house pad.

Fort Bend County, as well as most counties in Texas, has had a no burn ban in place for several months because of the lack of rain. It is still in effect even though we have had some rain recently. We have had a number of reports of property owners illegally burning during this time.

In order to enforce the no burn ban in Bridlewood, and protect homeowners, we are going to start issuing fines. You received the rules concerning fines several years ago. Our attorney wrote the rules for fines so that we would be on solid legal grounds. If you do not have a copy you can down load them from our website, or call Austin Properties, 713-776-1771 and ask for a copy. The fines start at $500 and go to $5,000.

This newsletter goes to every property owner in Bridlewood, so consider this a warning about the burn ban. We are fortunate that every Thursday, on the second pick-up of the week, you can put out all your tree trimmings, trees cut into 4 feet length, etc. at no extra charge. Please use this option instead of burning so you will not get a fine.



TRASH PICK UP

We have had a number of complaints at our monthly meetings about trash blowing around the neighborhood after a pick-up day. Also, property owners in Section Three are reporting that there is a lot of trash in the lake. Some of the trash in the lake is from builders who do not put papers and light material in a dumpster with a cover and allow the items to blow out and into the lake.

Most of the loose trash, though, is coming from our large trash cans on trash day. If you remember, when we were given the large cans we were told to put our trash in the can in bags...not loose. Obviously some homeowners are not following the instructions. When you do not put your papers, wrapping/packing materials, in a bag and tie the end, when the automatic arm picks up the can and turns it upside down to dump it in the truck, items will fly out. This makes a mess around your home. The wind blows it over the neighborhood and makes Bridlewood look as though our property owners do not care about keeping our property clean.

Please start putting all trash in plastic bags...the ones you get a the grocery store are good, and they are free. Also, remember to have the wheels of the can toward your home, not on the street as this causes your can to be hard to empty.



FINES

We are re-printing the section of our guidelines that contain the amounts of different fines. (See Below.) We mailed the entire section on fines in 2006 after our attorney wrote them for us. We are re-printing them in this newsletter because some property owners are questioning what improvements must be approved by the ACC before they can start.

Everything—additions, pools, fences, gates, homes, garages, barns, out buildings, or anything else that has not been approved by the ACC— is subject to a fine if you do not get ACC approval before you start. You can not even begin to prep the area until you have all permits and approval from the ACC.

The beginning fine is $500 and can go up to $5,000. In addition to the fine an additional amount is charged each month until the fine, and any extra amount, is paid in full. All fines must be paid before any new application will be approved by the ACC.



BRIDLEWOOD ESTATES FINING POLICY FOR VIOLATIONS

Following is a reprint of Section 7, a & b, from the Bridlewood Estates Property Owners’ Association, Enforcement Regulations and Fining Policy (“Policy”) for Violations of the Governing Documents, effective January 1,2006:

7. Fines.

a) Architectural Approval and Construction Process. Violations of the architectural approval and construction process are deemed to be among the most serious violations of the governing documents. There shall be a fine of up to $5,000 for commencing or continuing construction (including any site preparation work) of any house, outbuilding, or pool, prior to obtaining the written approval of the Architectural Control Committee (“ACC”). There shall be a fine of $500.00 for commencing or continuing construction (including site-preparation work) of any other type of improvement, including but not limited to, fences, gates, driveways, and landscaping. The aforementioned fines shall also apply to installing, constructing, or completing construction of any improvement and/or landscaping in a manner which is not in accordance with the written approval issued by the ACC. There shall also be a fine of $500.00 for other types of violations of the construction process, including but not limited to, failure to install a culvert, or provide a portable restroom or construction dumpster prior to commencing construction.

b) Other Violations of the Governing Documents. Other types of violations of the governing documents will typically incur a fine in the amount of $100.00 for completed violations, and $25.00 per day for continuing violations. Completed violations occur at a specific point in time (i.e. creating an unreasonable amount of noise so as to create a nuisance to the neighbors. such as by late night partying). Continuing violations typically occur over a period of time (i.e. storing an inoperable vehicle within the public view for several days or weeks in a row).

Discretion as to Amount of Fine. With regard to all of the fines to be levied hereunder, the Association reserves the right to increase or otherwise modify the final amount of the fine, based on such factors as the Board may consider in its reasonable discretion, including but not limited to, the severity, seriousness, or extent of the applicable violation, and for repeat violations.
